Welcome to Apna Crusher! These Terms and Conditions ("Terms") govern your use of the Apna Crusher mobile application, website, and related services (collectively, the "Platform"), operated by Apna Crusher Pvt. Ltd. ("Company", "we", "us", or "our").

By accessing, registering, or placing an order on our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.

1. Account Registration and Use

  • check_circle Eligibility: You must be legally capable of entering into a binding contract under the Indian Contract Act, 1872, to use this App.
  • check_circle Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials (e.g., OTPs) and account details. You agree to accept full responsibility for all activities and orders placed under your account.
  • check_circle Accurate Information: You must provide accurate delivery locations (GPS pins) and contact information. The Company is not liable for delayed or failed deliveries caused by incorrect location data provided by the user.

2. Pricing, Freight, and Payments

  • trending_up Dynamic Pricing: Material prices may fluctuate based on real-time market conditions at the respective sourcing zones (e.g., Khanak, Dadri). The material price displayed at the time of order confirmation is final.
  • distance Freight and Delivery Charges: Freight charges are calculated dynamically based on the GPS distance between the selected sourcing zone and your delivery site. Toll taxes, if applicable, are included in the final "Landed Cost" shown at checkout.
  • receipt_long Taxes: All applicable government taxes (including GST) will be clearly indicated on your final invoice.
  • pause_circle Payment Terms: Payments must be completed as per the terms agreed upon at checkout. The Company reserves the right to halt unloading at the site if payment obligations are not met upon the vehicle's arrival.

3. Delivery and Site Conditions

To ensure successful material dispatch and drop-off, the following guidelines and liability policies apply to site operations:

Accurate Site Access Data

The Customer is solely responsible for providing precise delivery locations and accurate site access details, including the exact street width. The Company relies entirely on the dimensions provided by the Customer to assign the appropriate delivery vehicle (e.g., 6-tyre truck vs. 14-tyre dumper).

Liability for Incorrect Dimensions: If the Customer inputs incorrect dimensions (for example, declaring a 35-foot wide street when the actual width is 24 feet or less), resulting in our assigned heavy vehicle getting stuck, being unable to negotiate a turn, or being forced to halt at a distance from the site, the Company shall hold no liability for the incomplete delivery.

Freight & Transshipment

  • warning In case of failed delivery due to wrong dimensions, the Customer remains strictly liable to pay the full freight and transportation charges.
  • info Transshipment Costs: Secondary transportation (e.g., local tractor-trolleys to move material from the halted vehicle to the site) must be managed and paid for entirely by the Customer.

Wait Times & Safety Refusals

  • schedule Excessive unloading delays caused by the Customer (e.g. lack of labor or uncleared site) may attract waiting charges (demurrage).
  • block If unloading is impossible due to safety hazards or undisclosed overhead wires, the Customer remains liable for full freight charges even if returned.

4. Weight Assurance and Disputes

We bill strictly based on exact weight in Tons, not volume (Sq. Ft.). Every dispatch is accompanied by a certified weighbridge slip from the sourcing zone.

1. Raising a Dispute

If you suspect a weight discrepancy, you must weigh the loaded vehicle at an independent, certified weighbridge near your site before unloading the material.

2. Verification Requirements

Claims regarding short material must be supported by uploading a valid, time-stamped slip from the independent weighbridge via the App. Claims made after unloading will not be entertained under any circumstances.

5. Cancellations and Refunds

Pre-Dispatch

Orders cancelled before loading at the crusher zone will be fully refunded without any penalty.

Post-Dispatch

If cancelled after leaving the crusher zone (Out for Delivery), the Customer pays full freight charges. Only material cost is refunded.

Refund Processing

Approved refunds will be processed back to the original source of payment within 5 to 7 business days.

6. User Content

By uploading weighbridge slips, site photos, or reviews, you grant the Company the right to use this data for verification, dispute resolution, and trust-building programs. You agree not to manipulate or submit false claims.

7. Liabilities

Company is not liable for Force Majeure events (severe weather, roadblock, weighbridge breakdown, strikes). In no event shall we be liable for indirect damages like site labor downtime or construction delays.

8. Governing Law

These Terms shall be governed by and constructed in accordance with the laws of India. Any disputes arising out of these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Hisar, Haryana.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the App or Website. Your continued use of the Platform signifies your acceptance of the updated Terms.
